Skill games are not gambling

Under US federal law and most state statutes, gambling is defined as a game where the outcome is determined predominantly by chance. THNDR's games are built differently.

The "predominant factor" test is the standard. THNDR passes it. Players with better strategies win more often, at measurable rates, across millions of games. That is a legal distinction, not a marketing claim.

THNDR has analysed 160,000,000 games of data to build a statistical defence. The data shows consistent strategy development, measurable improvement over time, and win rates that directly correlate with skill level. This evidence base supports every legal opinion THNDR provides to partners.

Wire Act, 1961
Written to target sports betting over wire communications. A 2011 DOJ opinion confirmed it applies to sports betting only. THNDR's skill games fall entirely outside its scope.
UIGEA, 2006
The Unlawful Internet Gambling Enforcement Act explicitly carves out games of skill. Section 5362(1)(E)(ix) exempts "any game where success is predominantly determined by skill." THNDR qualifies.

Federal law does not prohibit skill games

No active federal statute prohibits skill-based wagering between consenting adults. The Wire Act targets sports betting. The UIGEA explicitly exempts games of skill.

THNDR's legal team has reviewed all relevant federal statutes. The platform architecture and game mechanics are designed to sit clearly outside every applicable prohibition.

Legal opinions covering 42+ states

THNDR holds formal legal opinions covering the majority of US states. Coverage is reviewed and updated as state law evolves.

A small number of states have enacted explicit restrictions on skill-based wagering. THNDR's platform automatically excludes players in restricted jurisdictions at the network level, keeping partners clean without any additional configuration.

Outside the US, the majority of jurisdictions either explicitly permit skill-based wagering or carry no prohibition. THNDR has operated across the UK, Canada, Australia, and throughout Europe and Latin America.

Built-in player protections

Responsible gaming is a regulatory requirement in a growing number of jurisdictions. THNDR has the tooling built in: deposit limits, session time controls, self-exclusion, and cooling-off periods.
